Terms & Conditions

These are the Terms and Conditions on which Sprout and Bloom Nature Play Group ( ABN 91 266 314 755) will provide their services to you, the consumer.

In making a booking with Sprout and Bloom, you are accepting these Terms and Conditions.

1. DEFINITIONS

1.1 Australian Consumer Law means Schedule 2 of the Competition and Consumer Act 2010 (Cth).

1.2 Confidential Information of a party means any information regarding that party’s personal information or individual circumstances which is: (a) by its nature confidential; (b) designated as confidential by that party at the time of disclosure; or (c) which the other party knows or ought to know is confidential. Confidential information does not include information, documents or materials that are common property, are required to be disclosed by law or are available in the public domain in Australia otherwise than by a breach of these Terms and Conditions.

1.3FEES means the amount of $17.00 AUD per child, persession unless otherwise stated in writing by Sprout and Bloom Nature Play Group such as for guest visits or special events.

1.4 SERVICES means the provision and facilitation of sessions or events for sensory, messy and nature-based play intended for babies, and young children.

1.5 YOU means the person who has made the booking, the parent or guardian of a child who is participating in and attending the services, or any other person attending a session or event held by Sprout and Bloom Nature Play Group.

 

2. PROVISION AND FACILITATION OF SERVICES

2.1 Sprout and Bloom Nature Play Group shall provide the Services on the booked dates and times.

2.2 You acknowledge that sessions and events run by Sprout and Bloom may include items such as food-based products, water play, small pieces and loose parts. Wherever possible, Sprout and Bloom will use high grade, food-safe or natural ingredients, dyes, and colourings.

2.3 Sprout and Bloom is a nut and egg free play group and will consciously avoid using any other common food allergens, however we cannot guarantee cross- contamination occurrence.

2.4 Sprout and Bloom Nature Play Group takes no responsibility for any damage, loss or theft of any personal items.

2.5 Sprout and Bloom Nature Play Group activities may include activities that are age-specific, you will be made aware of this prior to/ during your session. Sprout and Bloom will not be liable to you for any loss, damage, or injury suffered by you or any of the children in your care.

2.6 During sessions, Sprout and Bloom facilitators may take photographs or videos for marketing purposes. These photographs and videos will be posted to Sprout and Bloom’s website, social media platforms, and/or used in advertising materials. If you do not wish to take part in these photographs and videos, or would prefer facial or identifying features cropped and/or blurred, please advise in writing prior to your booking, or advise Sprout and Bloom facilitators at the start of each booking.

3. FEES

3.1 Fees are payable in full at the time of booking. All bookings are made via the website only.

3.2 If you are booking multiple classes at one time, the Fees for every class booked will be payable at the time of booking.

3.3 Any discounts or sales promotions applying to the Fees is offered solely at the discretion of the owners and facilitators. Sprout and Bloom Nature Play Group reserves the right to amend or stop offering the said discount at any time.

3.4 No refunds will be provided for change of mind. Once the session has been booked and paid for, it will fall under our cancellation policy.

4. CANCELLATION, RESCHEDULING, AND NO-SHOW POLICY

4.1 If you or your child is unwell, we ask that you please do not attend your booking.

4.2 Your booking may be rescheduled, provided that you give at least 48 hours’ notice prior to the start time of the booking. Rescheduling a make-up session is subject to date and session availability.

4.3 If less than 48 hours’ notice is given, or if you don’t provide any notice, Sprout and Bloom Nature Play Group reserves the right to retain the full Fees for that booking. Unless under extenuating circumstances, of which will be determined on a case by case basis, at the full discretion of Sprout and Bloom Nature Play Group.

4.4 If you are late to your booking and begin later than the scheduled start time, no extra time will be provided, and the booking will still end at the scheduled finish time.

4.5 In the event of bad weather, Sprout and Bloom will either organise an alternative location, or make-up session for a later date. If either is not possible, we will contact you to organise rescheduling you for another planned session.

4.6 If the facilitators of Sprout and Bloom are personally unable to attend a planned session due to illness, emergency, or otherwise, Sprout and Bloom will contact you to reschedule your booking for a later date, or provide a refund.

4.7 Sprout and Bloom Nature Play Group reserves the right to cancel any class that has less than 10 attendees, due to the costs associated with each session. If Sprout and Bloom cancels a session in accordance with this provision, you will be able to book a make-up session for a future date.

5. YOUR OBLIGATIONS

5.1 Sprout and Bloom recommends that all participants wear old or inexpensive clothing, as the Services are messy and may result in staining to clothing. Sprout and Bloom Nature Play Group does not take any responsibility for any damage to clothing or personal items as a result of the Services.

5.2 You must follow all reasonable directions and instructions of Sprout and Bloom facilitators relating to the health and safety of you, your children, and the other participants, including precautions taken for COVID-19.

5.3 You are welcome to take photographs of your children during the session, however please be mindful of other children and families and never share images of other children showing their faces with a third party, including uploading images and videos to social media without the parent or guardian’s consent.

5.4 Children must wear appropriate clothing, including bringing appropriate shoes in the instance of nature walks that may sometimes occur during/ after the Services.

5.5 It is your responsibility to supervise all participants 18 years of age in your care, at all times. Sprout and Bloom is not a childcare service and will not take any responsibility for supervising any child during the Services.

5.6 It is your responsibility to answer all relevant questions in the waiver prior to booking your session with Sprout and Bloom, as truthfully and best to your knowledge, as possible.

5.7 Your personal belongings including but not limited to; electronics, car, purse, etc are your responsibility. Sprout and Bloom takes no responsibility for any loss, damage or theft of these items during your booking.
